The blame is on the owner in this case. He had previous history with the police and was trying to incite them by walking around and shouting at them. They were simply detaining him, not arresting him, to prevent him from interfering. The owner should have secured the dog before approaching police, or just not approach the police at all. The animal jumped out the window, went towards the officers, the officer tried to detain the animal but it lunged. He fired to protect him and his fellow officers from being maimed by a rottweiler (which have a very strong, bone breaking bite)
I feel awful for the dog (It wasn’t the dogs fault) but the officer was acting in self-defense. It was heat of the moment. He couldn’t fire with the taser or pepper-spray because the outcomes would’ve been unpredictable and again, it was the heat of the moment.
Now this man is trying to sue the department, which he’s done before, to get a free ride in life, when this situation was caused by him trying to draw attention to himself by blasting music and yelling at cops. The dog, unfortunately, was a victim of the owner’s stupidity.
I own a German Shepherd, and although he would never hurt anybody, I wouldn’t put him in this situation.
