Being arrested for driving under the influence is a serious matter. There are five steps to take after a DUI.
1. Contact an Attorney
First and foremost, when charged with a DUI a person must contact an attorney promptly. The fact is that the legal process associated with a DUI moves rapidly and experienced legal representation is necessary.
2. Do Not Make a Statement
A person charged with DUI should not make a statement to the police without an attorney present.
3. Make First Court Appearance
Be sure to appear at the initial court date scheduled in the case. Nothing significant happens at the proceeding beyond the court advising of the charges and the court inquiring whether an attorney will be hired. A warrant issues if a person fails to appear.
4. Request License Hearing
Action automatically is taken against a driver's license when a DUI arrest is made. A person has a right to a hearing regarding a license suspension. A request for a hearing must be requested promptly (oftentimes within a week) of the arrest.
5. Don't Drive During Suspension
Some people elect to drive when a license is suspended because of a DUI. If law enforcement stops a person in such a situation, the consequences can be extremely serious, including a longer license suspension and a new charge.
