The comedian came under fire today for allegations that he made a rape joke at a female audience member’s expense. But this kind of derogatory humor has been the basis of his shtick for ages.

An anonymous story about Tosh.0 host Daniel Tosh making a rape joke at the expense of a female audience member during a recent Laugh Factory set went viral last night, shortly after being posted to Tumblr. The story alleges that Tosh suggested it would be hilarious if this audience member got gang-raped. By this morning the outrage in response to the story — the veracity of which BuzzFeed Shift has not been able to independently confirm — had spawned a slew of angry tweets directed at Tosh.

This afternoon, Tosh apologized for the incident over Twitter — notably with the caveat that the quotes in the Tumblr post had been taken “out of context.”

We reached out to Tosh’s manager and the Laugh Factory for comment and await their response. But anyone who’s paid attention to Tosh’s career knows that he’s been making inappropriate rape (and race) jokes for years. In fact, this is the foundation of the humor of not only his stand-up sets, but also his Tosh.0 show on Comedy Central, the latest episode of which drew the highest ratings of any cable show that night. Take this knife rape joke based on gory YouTube footage of Muammar Q’addafi’s murder:
There was also the skit titled “Lightly Touching Women’s Stomachs While They’re Sitting Down.” Tosh explains the concept: “This is where you sneak up behind women who are sitting and lightly put your hand upon their stomach. Make sure she’s aware that you are in fact feeling a roll.” Then we get some footage of Tosh doing this to women. He encouraged his viewers to upload videos of them trying this fun activity out — and a bunch of dudes actually did.
He can probably get away with even more inappropriate jokes in his stand-up acts that aren’t televised. Here’s a short clip of him making a joke about his sister getting raped in his DVD special Happy Thoughts:
And here’s a clip of him in a television special calling two guys in his front row “fucking idiots” because they’re drunk (what else does one do at a comedy show?). “We’re going to edit you out, you know, like your parents wished they could?” Tosh says into his microphone, before forcing them to switch seats.
But that’s nothing compared to his constant assault on women. Here’s a clip from his show of him insulting women who went to the trouble of sending in tapes so he could compile a bit called “Stuff You Never Want to Hear Guys Say”:
It remains unclear exactly how the rape joke at the Laugh Factory went down (though Tosh’s apology suggests it happened in some form). Sadly, the most surprising thing about this report is that he felt it warranted a “sincere” apology.

Have you ever heard someone say something like: “Oh, that really pushes my buttons” ——-> It”s YOUR OWN FAULT YOU LET YOURSELF HAVE BUTTONS. YOU CHOSE TO HAVE BUTTONS. If someone gets offended by a joke. The offended party has some serious evolving/growing-up/maturing to do. —————- It’s as arbitrary as someone being offended by the color blue. It’s like seriously, your opinion is NOT more important than anyone else’s. As a global community, NOBODY’S OPINIONS matter. And this relates directly to the way our civilization is run/operated. WE NEED TO ARRIVE AT DECISIONS USING SCIENTIFIC THOUGHT/LOGIC. Ex:) if you were a passenger on a plane that was doing a barrel roll and you were quickly loosing altitude, you wouldn’t take a survey or ask people’s opinions about what to do about it. The pilot, who actually understands the science of flight, must act regardless of what the passengers THINK. So anyways, to get back to the subject of comedy. If you get offended, that is your own lack of development that caused you to be offended. If things like poverty, destroying lives by locking people in jail, and corporate greed offend you; find a way to engineer these issues out of our civilization (I’m talking about the Zeitgeist movement and transitioning away from a money-based economy into a resource-based economy)

For the people who keep telling others to stop being so sensitive, relax it’s only a joke and not to go to comedy shows if they don’t want to be offended I ask of you… where is the punchline? and if it’s observational humour (which it clearly isn’t or atleast hope it isn’t… [who observes rape and thinks its hilarious??!!)] where is the funny part? Honestly I don’t get the joke, explain it. The owner of the comedy club himself which I quote (from another related Buzzfeed artlicle) as saying “It was a comment — it wasn’t a joke…” Although in the later part of the article he also said “Michael Richards came from hatred. Daniel Tosh did not — it was a joke and that’s what comedians do.” If the owner of the comedy club himself has no idea of what a joke is what hope do the rest of us have??!! This is clearly not humour.

All these comments telling people to “relax it’s just a joke, don’t go to see comedians if you are so precious/don’t want to be offended” etc… I ask you, (all the controversy aside) where was the punchline and what exactly about the joke was funny? The ‘joke’ which the club owner said and I quote from another article about the incident published on Buzzfeed that “It was a comment — it wasn’t a joke” alas in the same article he also said “”Michael Richards came from hatred. Daniel Tosh did not — it was a joke and that’s what comedians do.” If the owner of the comedy club is so confused about what a joke is, what hope do the rest of us have? And why do some say it was a joke? Have you looked up the definition of joke? It has a punchline or if it’s observational humour it atleast has an element of humour about it, this my friends does not.

lauries6 11 months agoi think the world would be a much nicer place if people just got over themselves and stopped taking themselves and everything else so goddamned seriously. people. tosh is a comedian. if you don’t think he’s funny, don’t watch his show, don’t pay to see his standup. but don’t show up where he’s performing, proceed to heckle him, and then get all bent out of shape when he jabs back. i don’t care if he was doing jokes about rape or incest or genocide or something else equally non-PC. the point is, his job is to take that stage and make people laugh. obviously not everyone is going to have the same sense of humor. his humor happens to be a bit edgier than most, so if you’re easily offended, i’m going to tell you right now, you’re not going to find him funny. and though you’re absolutely entitled to that opinion, please keep in mind that not everyone in the world shares your point of view. i am a woman, i understand that rape is a serious subject, and i also happen to think daniel tosh is hilarious. there are plenty of others who share my point of view. there are plenty of others who don’t. i’m fine with that.

Amanda MacArthur 11 months agoShe paid to laugh at jokes about retarded people, dead babies, black people, etc. If she can laugh about those equally offensive things (equal depending who you are) she can laugh about rape. None of it is funny, but she paid for shock humor, so that’s what she got. Everybody still loves George Carlin and he did a skit about rape too. Move on please.

markl32 11 months agoTosh’s super-uncalled-for rape comments aside, a video of him dealing with drunks at his show is in no way connected to the issue. “What else do people do at comedy shows” besides drink? Most people listen. That’s like the #1 thing. And if they’re not listening, and the house isn’t dealing with them, the comic has to. And if he’s making jokes at their expense while he does? That’s fine! The problem with the rape joke wasn’t “Tosh is making fun of the audience!” The problem was with the very specific things he said. So I’m not supporting his rape comments, but the idea that this video somehow supports a character study of “Tosh the meanie” is absurd.

baseballgirl 11 months agoYes, comedy is, can be, and should be (allowed to be) offensive. Yes, I believe pretty much any subject can be joked about. Ricky Gervais is especially skilled at this. BUT, there is a HUGE difference between making a broad joke about a horrible thing (murder, cancer, rape, etc.) and pointing to a particular person and saying, “I think it would be funny if you were gang raped right now.” That is not a joke; it’s a statement. A statement which this woman interpreted, reasonably if not realistically, as a veiled threat.

I will be okay with rape jokes once someone can give me a good solid answer on why they’re funny. So far I’ve seen a lot of people sticking up for them, but not giving a good reason as to why we shouldn’t be “sensitive pussies”, as one commenter put it.

jairoj 11 months agoYou can’t censor comedy, if you are offended do not watch or hear it. Go to your safe comedians, enjoy them. But please stop acting like you are mightier than thou. People who tell jokes about rape are not rapist or encourage it…..you are not more moral than these comedians, nor probably smarter…you don’t get to tell somebody not to make a joke about something cuz it happened to you…my father die of aids, I have some funny jokes about aids, I laughed, I love the southpark episode about aids….too much fucked up things in life to loose your shit over a joke, the jokes are the things that makes us feel a little better about fucked up things. Shit I was molested and I still laugh at rape jokes.

Cade 11 months agoAlas, I came to the comments section on this article hoping to find some interesting discussion on the nature of comedy and its commentary on societal ills, why we as a society find certain topics offensive and how we decide which topics are taboo to joke about, hoping to see reasoned discussion from both sides of the argument on why no topic can be considered taboo for comedy or why the unique circumstances that define rape make it a subject too serious to make light of, all without the debate devolving into rigid posturing and pointless name-calling. Then I remembered I was on the internet. Silly me. I guess I’ll go find some pictures of corgis instead.
