Are You Informed About Informed Consent?

It's voluntarily, knowingly, and intelligently! Informed consent can be given orally, if you document the discussion and the reason.

It's only informed consent if it is made:

Informed consent includes limits of confidentiality, alternative treatments, nature of counselling, counsellor credentials, and record-keeping processes. The CCPA Standards of Practice (2015) stated that counsellors should not use client testimonials.

The Five-Step Model to informed consent is:

Consent forms are supplementary to a verbal discussion and should be created for approx. a grade 6 reading level. They shouldn't be overwhelming or require university-level comprehension.

It is the counsellor's responsibility to ensure their client can fully understand the consent they are giving. Translators may be required, even if the client can speak conversational English (or French). Even if a translator can't be used, the counsellor's responsibility to ensure understanding is not diminished! The reading provides strategies for these situations.

What language should informed consent be in?

Heck yes it is! Due to clients' preferences or cultural norms, they may want to involve others in their informed consent process.

Is informed consent valid if the client needs to consult with his husband first?

Know yer case law. Canterbury v. Spence 1972 modified this standard from reasonable doctor to reasonable person.

Which one is 'adequate disclosure' defined by?

Legally, informed consent is required and should be well-documented; however this is about quality, not quantity of paperwork. As well, informed consent claims are not a primary source of legal trouble for counsellors. A rights-based approach is less concerned with liability, and more concerned that clients are equal, informed, and consenting participants throughout counselling.

A good reason for approaching consent as an ongoing process rather than a single event include:

Additionally, you may have to tailor informed consent when clients have diminished capacity, when a dual relationship cannot be avoided, when computer applications are used, when services include third parties, or when clients participate in assessment. (However, informed consent should never be one-size-fits-all! Even for lawyers.)
