If the mandate gets struck down, the whole law goes down because the mandate was how the law was to be paid for. Not to mention it creates a loophole that breaks the system even worse that it was before. The loophole being that if the mandate is gone but the rest of the law is valid, then no one will purchase insurance until they need it because the law requires insurance companies to give health care to insure people regardless of preexisting conditions. So the insurance companies won’t receive as many premiums but will have people buying insurance when they need it breaking the system in the process
I still can’t understand how the same court that ruled that corporations are people can then undo healthcare for “real” people? Who exactly is this court working for? Remember when this body was created to help real flesh and blood people? Maybe if I had gasoline running through my veins…
I disagree that Romney will be “pressured” to introduce his own health care bill. If some or all of the current plan is scrapped, he’ll celebrate the “triumph of the constitution” and call for the private sector (I heard him touting the miracle of touchscreen food ordering this morning) to work its usual magic on the problem. He won’t want to step into that minefield before the election. The really interesting thing to see will be conservatives’ reactions to SCOTUS if they uphold it. A constitutional amendment to limit terms? A recall movement? Bounties?
