Florida Man Sentenced To Two And A Half Years For Having Sex On Beach

A 40-year-old man was sentenced to two and a half years in jail for having sex on the beach in front of minors. His 21-year-old partner was sentenced to time served.

A Florida man was sentenced Monday to two and a half years in prison for having sex on a beach in front of other beachgoers, including children.

Jose Caballero, 40, and Elissa Alvarez, 21, were convicted in May of two counts of "lewd and lascivious exhibition" for having sex on the beach in front of minors, after the jury was shown cell phone footage of the couple's act.

Alvarez was recently sentenced to time served, but Caballero received a harsher sentence because he previously served eight years for cocaine trafficking. The charges carried a maximum 15 years in prison. They both will have to register as sex offenders.

The pair denied having sex, arguing Alvarez had been "dancing" on top of Caballero.

The couple were filmed on July 20, 2014, while having intercourse on Bradenton Beach, a Gulf of Mexico beach. Witnesses said a 3-year-old girl saw the them, WPTV reported.

"I don't think the jury had any doubt that was sexual intercourse," Assistant State Attorney Anthony Dafonseca said after the ruling in May.

The jury found them guilty after deliberating for 15 minutes.
