San Francisco 49ers linebacker Ahmad Brooks has been accused of groping an unconscious woman in a lawsuit filed Tuesday.
Brooks is mentioned as a co-defendant in a lawsuit against former 49ers defensive end Ray McDonald, who the alleged victim claims raped her the same night. The alleged victim has been sued for defamation by McDonald, and this lawsuit is a countersuit.

According to the complaint, the woman has been made aware of a surveillance video at McDonald's home that she claims will show the following events:
In December 2014, the woman "slipped and fell on a negligently maintained, dangerously slippery deck near the swimming pool and struck her head." She claims that a result, she was knocked unconscious for over eight minutes. The woman claims McDonald did not call 911 because he didn't want to be liable for a "dead female to be found on his property."
The woman also claims that after she woke up, she slipped again and was once again lost consciousness. During that time, she says Brooks "groped her person in a sexual manner" and was then "carried upstairs by [McDonald] to his bedroom," where he "engaged in un-consented touching, restraint, and sex" with her.
Meanwhile, the woman's attorney, Gloria Allred, has also filed a motion to dismiss McDonald's defamation suit.
Allred is citing a California law that is meant to "encourage reporting to law enforcement so that victims or witnesses who report can do so without fear of being sued."
In her motion on behalf of the alleged victim, Allred contends McDonald's defamation claim "is a lawsuit by a powerful NFL player to bully — and further victimize — a rape victim who had the bravery to report the crime to the local police."
The Santa Clara County district attorney's office, however, has not filed charges against McDonald, although he was swiftly dropped from the 49ers when the allegations came to light.
In August 2014, McDonald allegedly physically assaulted his then-fiancée, but no charges were filed either due to insufficient evidence.
Still, the allegations were eventually enough for the 49ers to justify his release due to a "pattern of poor decision making."
He has since been signed by the Chicago Bears.
Though there were mentions of a second 49er present at the scene of the alleged sexual assault, Brooks had not been named until the defamation counter-suit.
Brooks has had his share of non-football issues during his time with the 49ers. In November 2014, he was benched for yelling at now–Head Coach Jim Tomsula. A few weeks later, he missed a team meeting and was benched again.
After the latest round of allegations, the 49ers quickly released the following statement:
The San Francisco 49ers organization is aware of the media report regarding Ahmad Brooks. We were disappointed to learn of this matter and will continue to monitor the situation.
