Reuters - A federal judge on Wednesday struck down a California ban on same-sex marriages as unconstitutional, handing a key victory to gay rights advocates in a politically charged decision almost certain to reach the U.S. Supreme Court.
A federal judge struck down a voter-approved ban on gay marriage, handing a temporary victory to gay rights advocates in a legal battle likely to be settled by the Supreme Court.
Prop 8 was overturned yesterday by Circuit District Court Judge Vaughn Walker who said that, “Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license.”
It’s good to know that fights in the legal system can still be won using common sense.
U.S. District Judge Vaughn Walker has ruled that California’s Proposition 8, the ban on same-sex marriage, violates the U.S. Constitution. The ruling was released on Wednesday afternoon at approximately 1:40 p.m.
