Uptick Rule

Barney Frank just said the SEC is going to bring back the uptick rule. So what is it? It's designed to slow down short-sellers by requiring them to sell at a price higher than the previous trade. The rule was created following the Great Depression and removed in July 2007. People have basically been calling for its reinstatement ever since.

  • This should have been the first thing Obama did. Frantic short selling has been one of the primary factors in the erratic market fluctuations lately, and in a climate like this, it has the potential to destroy otherwise healthy businesses.
