She upheld Bush's Mexico City Policy, for which she received a lot of criticism from her more liberal peers. Considering the justices Obama could have nominated, Sotomayor is pretty moderate.

Is there something wrong with the idea that conservatives should be offended by those comments? The first one is just arrogant and not worth responding to. But the suggestion that it is the court's job to make policy is irreconcilable with the rule of law. Of course she'll have enough votes in the Senate for a swift confirmation. But that doesn't mean concerns about her judicial philosophy are unfounded.

Actually, if you read that NYT article, the Judicial Confirmation Network has already issued a statement calling Sotomayor “a liberal activist of the first order.” So it's a pretty fair bet that other conservative organizations will continue along those lines.
