for the record, I wasn’t the one who bee lined for me after my post addressing the original comment. Then you wrote “Comparing a 11/9 year old possible relationship to a 18/15 yr old relationship is laughable.” What is laughable is the fact that you think you are right in your own head, despite there being nothing (literally) to back up your statements. My statements are completely accurate. Where would I like to get expert opinions? From an expert or from some rando? If you have, at the very least, a Juris Doctorate, feel free to make a legal argument. At least it will be backed by some effort to make sure the facts are right. But you’re a nobody on the interweb telling people that what you think is absolute is, in fact, absolute. And you jumped into a legal argument without knowing the law. I don’t think you know what snide and pretentious actually means. At most, I was sarcastic and showing the same lack of respect shown to me. With that said, I don’t think this will go anywhere. I think you flip a coin, heads = “it’s legal” and tails = “it’s illegal”. “Non law silly people” usually have the brains not to blurt out such absolute statements as blah blah blah is legal and blah blah blah is illegal. But hey, who said anything about using brain cells in an argument? Gracing you with anything more than shiny colors will just confuse you. No worries, stick to your coloring books and you’ll do alright.
Look at the original comment. She is saying they are only 2 years apart. 21 and 23. 40 and 42. She’s saying that 2 year difference should not be an issue in the eyes of the law. I’m just trying to point out issues in law. And then you come out of no where and criticize my response to the original comment without reading anything. 18 yr old and 15 yr old is still statutory rape. No matter how you justify it. You can be high school sweet hearts, as long as your parents (adults) want to press charges, they can. They are legal guardians. In the eyes of the law, children under the age of 18 have less rights than an adult (unless they are emancipated). So, if the parents press charges on behalf of their daughter, they have every right to do so. No matter how much of a butthole move it was, it is their right. Don’t jump into a legal argument if you know nothing about the law. Thanks.

when it comes to laws regarding minors, there can be no wiggle room or else you can make that argument for anyone. Boys come into sexual maturity at age 11. What if an 11 yr old had sex with a 9 yr old girl? Would that be ok? These laws are set up to protect children. Society have changed and kids are getting more and more sexually active at an earlier age. But the law is still the law. You can’t get around it because there is no wiggle room in the statutory rape laws. Otherwise, you will have to discard the law all together because you can’t set one person free from sex with minors and jail another one in a similar case. That would make the law ineffective.
according to the news article that buzzfeed linked. The police taped a conversation that the two girls had about their relationship. If there are any mention of sexual activity on that call, it would give police probably cause to arrest the girl. I’m guessing that the taped call would definitely come into play during the trial.
There was a juvenile detention center in Cook County, IL where the center was privately owned and operated. They would pay the judge who was presiding over juvenile matters a cut for every child that was sent to the detention center. The center gets government funding and they also charge the parent for boarding their children. So, the judge started to send bus loads of children to that juvenile even if they were innocent. And he would impose the harshest sentence he can. That judge eventually got into trouble, but all those children were scarred. They actually did a documentary of the children that came out of that detention center. A lot of them became traumatized adults.
This may surprise you, but the judiciary system is a business. If they can arrest every high school seniors, they will do so. Children under the age of 18 have less freedom than adults (interesting to note that prisoners also have less freedom as well because they are seen as ward of the state). So parents or legal guardians can press charges against other teens. Here’s how the system works. I do not know you, but I can press charges that you assaulted me a year ago. I don’t even need any proof that you assaulted me. I don’t need bruises or anything. And depending on the crime there is different statute of limitations. As long as I report assault within a year, you can be arrested. If it’s rape, there are no statute of limitations. I can file rape charges 50 years later if I choose to. Depending on the cop responding to the call, you can be locked up pending a court hearing. Now you may be completely innocent, but you’ll have to pay for a lawyer, pay bail, pay court fees to determine that. If you are proven innocent in court, you can sue the plaintiff for damages and attorney fees. Of course you can’t press charges against the plaintiff because the courts rarely penalize a plaintiff because they don’t want to discourage victims from filing. But during all this, you have paid into the system. You paid court fees, you paid lawyers, if you sue the plaintiff you paid lawyers again. The court system is a business. Just remember that.
The story said that the relationship started after she turned 18. So it is considered statutory. I don’t think petitioning the court would do anything. Most likely scenario is that she gets charged, convicted, gets a record and reduced sentence. It is a waste of time to have an online petition to try and free her appealing to the court system. I think she would have a better chance if the petition was to the Governor and she can get a pardon. Although pardons from Governors are pretty rare.
The law does not waver in some aspects. Those laws are called red line laws. Statutory rape is one such red line laws. The logic of the court is that if they start to waver on one case, then cases after that will have stare decisis to build a defense. When it comes to protecting minors, the courts really have no choice but to stick to the black letter of the law. The only thing they can do is to relax the sentencing a little bit depending on individual case.
