Actually, its NOT a crime to be an undocumented alien in this country. I know you think it is, or that it should be, but you’re wrong. Don’t believe me? Here’s Rudy Giuliani (you remember him, right?) who was a bad-ass federal prosecutor before becoming mayor of NYC explaining that to Glenn Beck. http://www.youtube.com/watch?v=FDo-ZVK4dc0 (Notice that when Glenn starts sputtering about how it must be a misdemeanor or something, Giuliani shoots him down again) If it were a crime, then we’d have to provide MANY MANY more procedural protections to immigrants who we’re deporting. For example, all those things that criminal defendants get, well, immigrants don’t get those things when they’re being deported (or, at least, the gov’t is not compelled to provide them). Oddly enough, were being an undocumented alien illegal, then deportations would probably cost the government more money and take longer. So yeah, a state police officer cannot arrest someone without a warrant for violating something which is not a crime. Funny how that works….
