The Sexomnia Defense

Ontario courts acquitted a man of sexual assault because he was in a state of “sexomnia” when he tried to have intercourse with a woman at a party. When she woke up, he had taken off her underwear, pulled up her skirt and was on top of her wearing a condom. Is this “non-insane automatism,” a legitimate mental illness, or just a variation of the “I was wasted” defense?
