      First, there’s no reason to spray him after he’s restrained. But, he wasn’t gagged… it’s a spit shield. A very thin, loose fitting, piece of fabric. (but if it was sprayed with pepper spray it would hold on to the spray and prolong the effects of the spray.) And the restraint chair is used when a person is either trying to harm himself or personnel.  The restraint chair or the spit hood, used properly, are not torture. But again, once a person is restrained, there’s no need to spray them. That’s not the intended use of the spray. Spraying a restrained person is a punitive action, which is not allowed. The spray is intended to incapacitate a person temporarily so you can restrain them or take them into custody. If they sprayed him while restrained, they are in the wrong. But don’t paint with too broad a brush. The jail is responsible for preventing a person from harming themselves too, and the restraint chair is one of the most humane methods by which to do it. And you don’t pay jail personnel enough money to take home communicable diseases to their families because some jerk wants to spit on them… hence the spit hood.
